Personal Data Protection Act
Kintsu Physiotherapy Sdn. Bhd. [Company No.: 202401011555 (1557405-M)] (“Kintsu”, “we”, “our”, “us”) respects and is committed to protecting your Personal Data (as defined below) and your privacy. This Personal Data Protection Notice (“Notice”) explains how we collect and handle your personal information in accordance with the Personal Data Protection Act 2010 including any amendments thereto and the applicable laws and regulations. Please note that Kintsu may amend this Notice as and when it deems necessary or as required by law. You shall be notified of any amended Notice through email.
1. Personal Data
1.1 Type of Personal Data
“Personal Data” means any information which relates to you and which was collected or provided to Kintsu for the purposes stated in Section 2 below. In order for us to fulfill one or more of our obligations listed in Section 2 herein, we will need to collect relevant such information from you. The Personal Data collected, recorded, stored, used, disclosed and/or processed (collectively referred to as “Process”) by us may include, but is not limited to:
(a) Name, date of birth, NRIC number or passport number, gender, nationality, preferred language, ethnic origin, occupation, photographs or other images, security recordings, voice recordings, cookies, home and/or business address, telephone and/or mobile phone number(s) and email address, and any other form of contact information that can allow us to reach you for communication purposes; and
(b) Physical and mental health, religious or other beliefs of a similar nature (“Sensitive Personal Information”).
1.2 Source of Personal Data
We may obtain your Personal Data from the following sources, where applicable:
(a) Directly from you when you communicate with us (e.g. enquiries);
(b) From forms or information you provide for transactions, contests, promotions, or marketing responses;
(c) As applicable, from publicly available or accessible sources;
(d) From written or verbal communications before or during our (pre-)contractual dealings; and
(e) From third parties connected to you or where you have consented to disclosure, or where otherwise legally permitted.
1.3 Obligatory Personal Data and failure to supply
Providing your Personal Data (including Sensitive Personal Data) is mandatory unless stated otherwise. By submitting your Personal Data (including Sensitive Personal Data), you explicitly consent to its processing and confirm that all information provided is accurate and lawfully obtained. Your continued engagement with us is deemed ongoing consent for the purposes set out in Section 2 below. Failure to provide the required Personal Data may:
(a) Prevent us from delivering the requested notices, products, or services;
(b) Affect our ability to process transactions or fulfil obligations; and/or
(c) Limit our ability to update you on new products, services, promotions, or events.
2. Purposes of Collecting and Processing Personal Data
Personal Data you provide will be processed by us for, amongst others, the following purposes as applicable:
(a) To deliver and market our products or services to you via email, phone, text or social media;
(b) To prepare and enter into agreements or contracts for the sale and supply of Kintsu’s products or services;
(c) For our internal record management in the ordinary course of business;

3. Storage and Retention of Personal Data
Your Personal Data may be stored in hard copy at our office or electronically on password-protected servers. Any Personal Data supplied by you will be retained by our organization for as long as necessary to fulfil the purposes stated in Section 2 above or as required by legal, regulatory, commercial or accounting obligations subject to prevailing legal requirements.
4. Disclosure of Personal Data
4.1 For Kintsu’s personnel, Kintsu will ensure that:
(a) access to your Personal Data is restricted to employees who are contractually required to process your Personal Data in accordance with their respective job requirements; and
(b) only necessary information is released to the relevant employees.
4.2 For classes of third parties, Kintsu will ensure that:
Your Personal Data may be disclosed to relevant third parties (within or outside of Malaysia) as required by law, pursuant to relevant contractual relationship (e.g., appointed service providers) or for the purposes stated in Section 2 above (or related purposes).
In the event of a potential, proposed or actual sale of business, disposal, acquisition, merger or re-organization (“Transaction”), your Personal Data may be required to be disclosed or transferred to the relevant third party and its advisors. You hereby acknowledge and consent to such disclosure and transfer.
Your Personal Data may be disclosed to the following classes of third parties:
(a) Service providers appointed by us (e.g. banks or financial institutions, software vendors, auditors, lawyers, company secretary, professional advisors, printing companies, event organizer, insurance companies and other advisers);
(b) Business partners or affiliates involved in delivering the requested services; or
(c) Law enforcement agencies and relevant governmental authorities, statutory authorities, local council and industry regulators.

6. Right to Access and Correct Personal Data
6.1 You have the right to access to your Personal Data held by us and correct the inaccurate, incomplete, misleading or not up-to-date Personal Data. In this respect, you may in writing:-
(a) Check whether we hold and process your Personal Data;
(b) Request access to such Personal Data;
(c) Request correction of wrong Personal Data;
(d) Request explanation on our policies and procedures in relation to Personal Data handled by us;
(e) Communicate to us your objection to the use of your Personal Data for marketing purposes; and
(f) Withdraw, in full or in part, your consent given previously subject to applicable legal requirements/restrictions, our contractual obligations and a reasonable time frame.
6.2 Accuracy of Personal Data
You are responsible for informing us about any changes to your Personal Data to enable us to keep your Personal Data accurate and current.

8. Conflict
In the event of any conflict between this English language Personal Data Protection Notice and its corresponding Bahasa Malaysia Personal Data Protection Notice, the terms in this English language Notice shall prevail.
